- Oh, and the transfer can’t happen for at least eight days because, you know, Constitution. Plenty of time for the court to say, “Hold up, this is ours!” or for someone to spill coffee on the server. Whichever comes first.
Arbitrum delegates said, “Let’s do this!” and approved the release of $71 million in ether after the Lazarus-linked rsETH exploit. Because nothing screams “decentralized governance” like a direct clash with a U.S. court. Popcorn, anyone?
The vote closed Friday, Hong Kong time, with 90% saying, “Yeah, let’s give this money back.” Because 30,765 ETH just sitting there was clearly too tempting for the Lazarus Group, who apparently used unbacked rsETH tokens as collateral. Genius. Or just bold. I’m still deciding.
The funds are supposed to go to a recovery effort led by Aave, KelpDAO, LayerZero, EtherFi, and Compound. Because when you lose $230 million, you call in the Avengers of DeFi.
But wait, there’s more! The frozen ether is also the star of a legal drama in Manhattan. Attorney Charles Gerstein is like, “That’s North Korea’s money!” while Aave’s like, “No, it’s our users’ money!” And the court’s like, “Can we all just get along?” Spoiler: No.
Aave’s trying to vacate the restraining notice, saying the assets belong to innocent users. Gerstein’s like, “Nah, it’s fraud, not theft. They legally own it now.” Because nothing says “legal title” like deceiving a lending market with worthless collateral.
And the best part? The funds can’t move for at least eight days. Plenty of time for the court to step in and say, “Surprise!” or for someone to realize they left the server unlocked. Either way, it’s a mess.
Arbitrum delegates weren’t exactly flying blind, though. They included indemnification protections because, you know, legal risks. Because nothing says “we’re serious” like covering your own backside first.
Linda Jeng from Aave Labs said the exploit made them rethink their risk framework. Now they’re looking at cybersecurity, interoperability, and technical architecture. Because apparently, financial metrics weren’t enough. Who knew?
Jeng also compared this to the 2008 financial crisis, saying, “We bailed ourselves out.” Because nothing says “we’re different” like a self-rescue mission. Kudos, I guess?
